PRIVACY POLICY
under art. 13 of Decree n. 196 of 30 June 2003


1)    Purpose and modalities of personal information collection
ESTENERGY S.p.A. collects personal information to manage the services outlined in its company objectives (sale of energy products and services throughout Italy) to ensure one or more of the following:

  • to fulfil the legal and contractual obligations to which the customer is a party;
  • to provide information at the request of a customer before a contract is signed;
  • to manage commercial relationships effectively.

Personal information, stored on paper or electronically or on other media is collected during the following stages: compilation, registration, organisation, filing, processing, amending, selection, extraction, comparison, usage, linking, blocking, communication, distribution, cancellation and destruction. All these stages take place only in relation to managing the services referred to above.

2)    Compulsory supply of personal information
The supply of personal information is mandatory for the purposes of managing services delivered by ESTENERGY S.p.A. as referred to above.

3)    Effect of refusal by the party concerned
In the event that the party concerned refuses to provide their personal information ESTENERGY S.p.A. will be unable to follow up on the delivery of the services and transactions described in the contract.

4)    Parties to whom information may be given
Information provided by the party concerned may be transmitted for the purposes referred to above to: government authorities authorised by law, operators delivering outsourced services on behalf of ESTENERGY S.P.A., consultants and self-employed contractors, companies and enterprises, controlling, controlled and associated companies, banks and financial institutions and any other entity when required to by law.

5)    Rights of the person concerned (Art. 7 of Decree 196/2003)
  • The person concerned has the right to obtain confirmation as to whether or not personal information about them is held, even if it is not yet registered, and to have the information shown to them in an intelligible format.
  • The person concerned also has the right to information about:
    • the source of their personal information;
    • how and for what purpose the information will be used;
    • the logic applied where processing takes place using computer software;
    • the name of the Owner of the information, the Managers of the information and the Designated Representative;
    • the persons and categories of persons to whom the information may be given or who may see the information as the designated representative in that geographical area of the government, the management or their agents.
  • The person concerned is also entitled:
    • to update, correct or, where appropriate, add to information;
    • to delete, render anonymous or block information processed in breach of the law, including information which does not need to be stored for the purposes for which the information was collected or subsequently processed;
    • to written confirmation that the actions described at sections a) and b) below have been brought to the attention of anyone to whom the information has been communicated or distributed, including with regard to content, except where this is impossible or would require the use of resources which would be obviously unreasonable with respect to the right in question.
  • The person concerned may wholly or partially oppose:
    • for legitimate reasons, the processing of personal information despite this being appropriate to the purpose for which it was collected;
    • the use of personal information for the delivery of advertising or direct marketing material or market research or other commercial contact.

6)    Security, ownership and duration of use
Personal information is subject to security measures under Art. 31 of Decree 196/2003 aimed at limiting as much as possible the risk of destruction and/or loss, including accidentally, of the information itself, unauthorised access or use that is unlawful or inappropriate for the purposes for which it was collected.
ESTENERGY S.p.A. is the owner of the information through its official representative domiciled at the Company's office in Trieste, Via dei Rettori, 1, Tel. 800 046 200.
The person responsible for the use of personal information is the Sales Director of ESTENERGY S.p.A., domiciled at Trieste, Via dei Rettori, 1, Tel. 800 046 200.
